What is the disability review process in New Jersey?

After you are approved for Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) in New Jersey, your case does not remain static forever. The Social Security Administration (SSA) conducts periodic disability reviews to determine whether you continue to meet eligibility requirements. Understanding this review process can help you prepare and maintain your benefits without interruption.
Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.
Please answer a few questions to help us determine your eligibility.
1. What is a Continuing Disability Review (CDR)?
A Continuing Disability Review (CDR) is an evaluation conducted by SSA to verify that:
- Your medical condition still meets their definition of disability
- There has been no improvement that allows you to return to work
2. When Does SSA Conduct Disability Reviews?
Reviews depend on the severity of your condition and the likelihood of improvement:
- Medical Improvement Expected (MIE): Reviewed approximately every 6-18 months
- Medical Improvement Possible (MIP): Reviewed approximately every 3 years
- Medical Improvement Not Expected (MINE): Reviewed approximately every 5-7 years
Your award notice will state the review schedule assigned to your case.
3. The Disability Review Process in New Jersey
A. Receiving the Review Notice
You will receive a notice from SSA informing you that your case is under review. This will include forms to complete and return by a specified deadline.
B. Completing the Forms
The most common forms sent are:
- SSA-454 (Continuing Disability Review Report): For adult reviews, asking about your condition, treatments, doctors, medications, and work activity
- SSA-455 (Disability Update Report): A shorter form sent for mail reviews if your case does not raise immediate concerns
It is crucial to:
- Answer questions honestly and thoroughly
- Provide updated contact information for all doctors and treatment providers
- Include details of hospitalizations, therapy, or changes in your condition
C. Medical Records Review
SSA will:
- Contact your medical providers to obtain recent records
- Evaluate whether your condition has improved enough for you to return to work
- Possibly require you to attend a Consultative Examination (CE) with a doctor contracted by SSA for an updated evaluation
D. Decision Making
After reviewing all submitted information and medical evidence, SSA will:
- Determine whether your disability still prevents you from working
- Either continue your benefits or issue a cessation notice explaining why your benefits will end
4. What Happens If SSA Finds You Are No Longer Disabled?
If SSA decides your condition has improved and you are no longer eligible:
- You will receive a cessation notice detailing the decision and your appeal rights
- You have 60 days to appeal if you disagree with the decision
- If you appeal within 10 days, you can request that your benefits continue during the appeal process
5. Preparing for a Disability Review
To maintain your benefits smoothly:
- Attend all medical appointments: Consistent treatment shows SSA that your condition remains severe
- Follow prescribed treatments: Unless you have valid reasons not to, such as side effects or medical advice against it
- Keep detailed records: Maintain copies of doctor visits, test results, therapy notes, and any hospitalizations
- Update SSA promptly: Report any changes in your medical condition, address, or income
